Certain applicants who are in Australia can access Medicare while their applications are under consideration. Whether or not a visa applicant is entitled to Medicare benefits can be determined by looking at the Health Insurance Act 1973. Under s.10 of that Act “eligible persons” have access to Medicare.
Under s.3(1) an “Eligible person” is an Australian resident which includes:
o those who hold temporary visas and who have applications for permanent visas pending, and
o whose spouse, parent or child is an Australian citizen or permanent resident, and
o whose temporary visa permits them to work, and
o who has not applied for a parent visa, unless they are within a prescribed class of persons
